STEP ONE:

Please have your Certificate of Liability Form ready to be attached before beginning the application process. Submissions without this form will be rejected.

STEP TWO:

Please review Section 1: Sports Field Rentals. It is required for Section 1 to be acknowledged, signed and dated before moving on to Section 2.

STEP THREE:

Section 2: Sports Field Permit Application. Don’t leave fields blank. Please type, “N/A” or “Not Applicable” for questions that do not apply.

STEP FOUR:

Section 3: Release of Liability and Indemnification for Damages. Don’t leave fields blank. Please type, “N/A” or “Not Applicable” for questions that do not apply.

STEP FIVE:

Please attach the Certificate of Liability Form from your insurance company in Section 4: Certificate of Liability Form. Submissions without this form attached will be rejected.

STEP SIX:

  1. To accept the terms and conditions outlined in the Mill Creek MetroParks Sports Field Reservation Permit Guidelines
  2. To abide and enforce all guidelines and regulations listed in the Mill Creek MetroParks Sports Field Reservation Permit Guidelines and inform our members of the guidelines & regulations.
  3. To pay the required fees and deposits as listed in the Mill Creek MetroParks Sports Field Reservation Permit Guidelines
  4. To pay fees for any security staff needed as determined by Mill Creek MetroParks Police Department
  5. To schedule our organization’s activities on Mill Creek MetroParks fields only on hours and dates permitted for our use through the Mill Creek MetroParks Recreation Department.
  6. If playing as an organized group as defined in the Mill Creek MetroParks Guidelines: To procure, maintain, and provide proof of, for the duration of the agreement, required insurance against claims for injuries to persons or damage to property which may arise from or in connection with the use of the premises; to submit a completed Mill Creek MetroParks "Release of Liability and Indemnification for Damages" form; and to include Mill Creek MetroParks in all particpant waiver of liability forms used by the group.
  7. To defend, indemnify and hold harmless Mill Creek MetroParks, their officers, officials, employees, and volunteers from and against any and all claims, suits, actions, or liabilities for injury or death of any person, or for the loss or damage to Mill Creek MetroParks property, which arises out of the use of premises or from any activity, work or thing done, permitted, or suffered by User in or about the premises, except only such injury or damage as shall have been occasioned by the sole negligence of the Mill Creek MetroParks.

Section 3: Release of Liability and Indemnification for Damages

 

When the Group or Organization listed above is a corporation, limited liability company, partnership, or other separate legal entity, I represent and warrant that I am authorized to sign this document on behalf of the Group or Organization. When the Group or Organization listed above is an unincorporated association or otherwise does not constitute a separate legal entity, I represent and warrant that I am signing this document on my own behalf intending to be legally bound thereby. In consideration of the approval hereinafter given by the Board of Park Commissioners of the Mill Creek Metropolitan Park District (The “Board”) and/or its duly authorized representative, I, for myself or as the authorized representative of the above-referenced Group or Organization, as the case may be, hereby elect to, and do indemnify, hold harmless and assume all risks for claims heretofore or hereafter arising from the activity listed below on MCMP lands.

I also, for myself or as the authorized representative of the above-referenced Group or Organization, as the case may be, hereby knowingly and voluntarily expressly release the Mill Creek Metropolitan Park District (“MCMP”), the Board, and employees of MCMP from any and all claims arising out of the above listed activity on MCMP lands. Further, I, for myself or as the authorized representative of the above-referenced Group or Organization, as the case may be, agree to indemnify and reimburse MCMP for any damage to MCMP property caused by, resulting from, or arising out of the Activity described above.

 

I acknowledge that I have voluntarily chosen to participate in or allow my child to participate in this recreational activity/reservation offered by Mill Creek MetroParks. In consideration of permission granted to me or my child to engage in the recreational activity/ reservation, I, the undersigned, on behalf of myself, my heirs, executors, administrators, and assigns, agree to the following terms and conditions, which release Mill Creek MetroParks, its employees, public officials, agents, officers, assigns, and volunteers (herein collectively referred to as Mill Creek MetroParks) from any potential liabilities arising from participation or attendance:

Assumption of Risk: I understand that participating in recreational activities/reservations involves inherent dangers, including but not limited to the risk of personal injury (physical or emotional), property damage, paralysis, disability, or death. I recognize and voluntarily accept all of the potential risks and hazards associated with participating in said activities, regardless of how remote and unlikely. These risks may arise from various factors, including but not limited to the nature of the sport, equipment used, environmental factors, terrain/field conditions, and the actions or inactions of others.

Waiver of Liability: In consideration for being allowed to participate in this recreational activity/reservation, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby fully and forever release, discharge, and hold harmless Mill Creek MetroParks from any and all claims, liabilities, demands, actions, or causes of action, whether directly or indirectly related to any loss, damage, or injury, sustained by me or my child while participating in the program. This waiver and release is intended to and does release Mill Creek MetroParks from any and all liability for damages or injuries of or in any way related to or growing out of participant negligence, the negligence of third parties, and/or the negligence of Mill Creek MetroParks.

Indemnification: I agree to indemnify and hold Mill Creek MetroParks harmless from any and all claims, suits, actions, damages, liabilities, costs, or expenses, including reasonable attorney fees, arising directly or indirectly from my participation in recreational activities/reservations and any claims brought by third parties as a result of my actions or negligence.

Medical Treatment: I hereby consent to receive medical treatment and hereby consent on behalf of my child to receive medical treatment, which may be deemed advisable in the event of injury, accident, and/or illness during the activity/reservation. I acknowledge and understand that I am solely responsible for any medical expenses or treatment that may arise from any injuries sustained while participating in the activity/reservation.

Compliance with Rules and Regulations: I agree to comply with all rules, regulations, and safety guidelines established by Mill Creek MetroParks and its designated program staff. Failure to comply with these rules may result in my immediate removal from the recreational activity/reservation without any refund or compensation.

I have read this waiver carefully and understand its contents. I acknowledge that by signing below and/or clicking the accept box, and/or by paying the fees associated with such recreational activity/reservation, I voluntarily and willingly assume all risks associated with participating in the recreational activity/reservation and release Mill Creek MetroParks from any and all liabilities.
